PLEASE READ THESE TERMS AND CONDITIONS BEFORE YOUR PURCHASE
A refurbished phone is any smartphone that has been restored to workable condition and performance. You might also hear it referred to as a renewed, reconditioned or restored phone, but these all mean that the phone has undergone a process of repair, cleaning, and testing such that it meets the minimum standards to enable a working device. There is no guarantee that it will perform like-new and you accept the device on an ‘as is, where is’ basis (“Refurbished Device”).
LIMITED WARRANTY CONDITIONS
§ All Refurbished Devices come with a limited 3 months warranty from the date of purchase (“Warranty”). A Refurbished Device is eligible for repair only under Warranty to restore it to working condition (excluding damages caused by your recklessness, negligence or carelessness whether intentional or unintentional).
§ No claims shall be accepted for replacement or refund beyond this limited Warranty such as hardware malfunction caused by you, software misuse (including third party software), jailbreaking, custom firmware, viruses, malware, spyware or any other cyber risk.
§ Your Warranty will not be valid past the 3 month warranty period.
§ Cosmetic imperfections may arise due to normal wear and tear (scratches, dents, cracks, discolouration etc). This limited Warranty excludes support to address these.
Refurbished Devices may be bought with accessories and such accessories will not be eligible for any repair or replacement under this Warranty.
§ For clarity, this Warranty is limited to the Refurbished Device and its standard battery.
§ To exercise this Warranty, it is your responsibility to return the Refurbished Device to your nearest Digicel outlet at your own cost and risk. Upon repair, this Warranty continues in effect until the end of its 3 months term from the date of purchase.
RELATED TERMS AND CONDITIONS
§ Fees may apply for inspection and repair performed by third parties. Any such fees will be communicated to you prior to an inspection and will only proceed upon you accepting these related costs. In the event related costs cannot be quantified beforehand, this will also be communicated to you for your acceptance.
§ This Offer is valid on Refurbished Devices as defined in these terms and conditions.
§ This Offer is valid till stocks last.
§ Our maximum aggregate liability under this Offer whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount paid by you in respect of the Refurbished Device on the date of purchase.
§ Pictures/images of Refurbished Devices (whether or not in packaging) by us on our website, in advertisement in print or online, are for illustrative purposes only and may not represent the true nature of the Refurbished Devices as these may vary.
§ Any behavior verbal or physical that is aggressive, offensive, a threat or derogatory regardless of medium (in person or digitally) is unacceptable. Our staff reserve their right to cease communication with you and report your conduct to relevant authorities (including onsite security).
§ We reserve the right to vary these terms and conditions in relation to this Offer and the Refurbished Devices from time to time.
